Terms and Conditions
1. Acceptance
By accessing or participating in any EDSS program, website, event, or service, users agree to be bound by these Terms and Conditions.
2. Programs and Services
EDSS provides scholarship opportunities, fundraising facilitation, community engagement programs, and educational initiatives. Participation is voluntary and subject to availability.
3. Scholarship Funding Contingency
All scholarships are community-funded and contingent upon available funding. EDSS makes no guarantee that scholarships will be awarded in any given year. Announcement or prior award history does not create a contractual obligation.
4. Fundraising Structure
Fundraising programs operate under a dual-funding model: - Sponsor contributions paid to EDSS support facilitation and administrative services. - Event proceeds and campaign donations are intended for benefiting schools and are not guaranteed.
EDSS does not act as a fiduciary, trustee, or escrow agent for any party.
5. No Guarantee of Results
EDSS disclaims any guarantee regarding fundraising outcomes, attendance, sales volume, or financial performance.
6. Event Modification or Cancellation
EDSS may modify, postpone, or cancel events due to safety, compliance, funding limitations, weather, or force majeure. Such actions do not constitute breach.
7. Donations and Payments
Donations are voluntary, non-refundable, and subject to third-party processing. Sponsor contributions are non-refundable and constitute payment for facilitation services.
8. Intellectual Property
All materials created, produced, or distributed by EDSS or in connection with EDSS programs, including derivative works, are the exclusive property of EDSS unless expressly stated otherwise.
9. Limitation of Liability
To the fullest extent permitted by law, EDSS shall not be liable for indirect, incidental, consequential, or punitive damages.
10. Indemnification
Participants agree to indemnify and hold harmless EDSS from claims arising from participation or misuse of services.
11. Arbitration and Governing Law
Any dispute shall be resolved by binding arbitration in Florida under applicable rules. Florida law governs these Terms.
12. Modifications
EDSS reserves the right to amend these Terms at any time without notice as permitted by law.
13. Severability
If any provision is deemed unenforceable, remaining provisions shall remain in full force.
